JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 147, 353, 307, 323, 379,224 and 34 of the Indian Penal Code. Allegedly, the petitioner and other accused persons assaulted the police party while the party was conducting raid in the house of one Tarkeshwar Yadav. Allegedly, the members of the police party sustained injuries caused by the petitioner. I do not find it to be a fit case for grant of benefit of anticipatory bail to the petitioner. This application is, accordingly, rejected.

Let the petitioner surrender before learned A.C.J.M., Danapur in Bihta PS case No. 481/2014 within a period of two weeks from today and seek regular bail, if so advised. If he does so, the court below shall consider his prayer for regular bail on its own merit without being prejudiced by dismissal of the present anticipatory bail application.
