The petitioners pray for bail in a case registered for the offence under Section 272, 273 of the I.P.C. and Section 30(C)(D)/32 of Bihar Prohibition and Excise Act. Total 4740 Kg. Ammonium Chloride (Nausadar) and Jaggery have been recovered from a truck, of which, petitioners are driver and co-driver.

It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. Petitioners were not aware about the nature of consignment and simply following the instruction of the owner. Petitioners claim clean antecedent and are in custody since 14.02.2022.

Patna High Court CR. MISC. No.18765 of 2022(2) dt.26-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court I, Purnia in connection with Purnea Sadar P.S. Case No. 106 of 2022.
