JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

There is specific allegation against petitioner and other co-accused that they assaulted the deceased brutally with lathi-danda as a result of which deceased died then and there. Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Ariyari P.S. Case No. 11 of 2016 pending in the court of Sub-Divisional Judicial Magistrate, Sheikhpura stands rejected.
