20-11-2017 Heard Sri Raghav Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 02-08-2017 in Hussainganj P.S. Case No. 206 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 41(1), 30, 36, 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

Learned counsel for the petitioner, at the very outset, has drawn my attention to the statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It was further submitted that petitioner was apprehended on an accusation, as if petitioner was driver of a tempo, from which, about 27 liters of country-made liquor and 11 liters of Indian make foreign liquor were recovered. No.55428 of 2017(2) dt.20-11-2017 2/2 petitioner has disputed the prosecution allegation that he was driver of the vehicle, rather he submits that petitioner was simply a passenger and when the vehicle was intercepted, the driver fled away and petitioner was apprehended, as if he was driver of the vehicle.

Be that as it may, considering the nature of accusation, period of custody as well as clean antecedent of the petitioner, let the petitioner namely Deepak Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II, Siwan in connection with Hussainganj P.S. Case No. 206 of 2017.
