Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 5.5.2017 passed in Cr. Misc. No.16793 of 2017.
Submission of the learned counsel for the petitioner is that she died due to illness and further it is submitted that in this case the informant was examined before the learned trial court and he had stated in his cross examination that she was not tortured for demand and later on he came to know that she died due to illness and she was never tortured and further submission is that he is brother of the deceased. It is further submitted that the petitioner is in custody for 2 1⁄2 years.
Patna High Court Cr.Misc. No.53116 of 2018 (2) dt.05-09-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions JudgeIIIrd-cum-Special Judge, Vaishali at Hajipur in connection with Bhagwanpur P.S.Case no.54 of 2016 dated 23.3.2016 with condition that one of the bailors shall be local one having properties within the jurisdiction of the court concerned and he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
