JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 376/34 of the Indian Penal Code and Section 3(i)(x)(xi)(xii) of the SC/ST Act. Petitioner and other co-accused forcibly entered into the house of the informant, petitioner put pistol on informant whereas other co-accused committed rape on her. The informant was minor and she belongs to Scheduled Caste Community. Submission on behalf of the petitioner is that the prosecution story does not find support from medical report and there is a delay in lodging the present case.

Patna High Court Cr.Misc. No.25803 of 2016 (2) dt.22-06-2016 2/2 Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Lakhisarai P.S. Case No. 12 of 2013 pending in the court of Additional Chief Judicial Magistrate, 1st, Lakhisarai stands rejected.
