JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioner, who is in custody since 12.09.2019, seeks bail in connection with Buniyad Ganj P. S. Case No. 171 of 2019 dated 11.09.2019 instituted for the offences under Sections 302 and 34 of the Indian Penal Code and 3/4 of the Prevention of Witch (Daain) Practices Act, 1999.

It has been alleged in the F.I.R. that on the suspicion of the deceased, who is the father-in-law of the informant, of having committed necromancy / witchcraft on the husband of the informant leading to his death, the father-in-law of the informant was killed by the petitioner and others. The petitioner is alleged to

Patna High Court CR. MISC. No.16513 of 2020(2) dt.01-06-2020 2/2 have slit the throat of the deceased by means of a fasuli, a sharp-cutting weapon.

Considering the nature of accusation against the petitioner, I am not inclined to grant bail to the petitioner for the present.

The trial of the petitioner ought to be expedited and concluded.
