Petitioner seeks bail in a case registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code.

Informant in his written complaint has alleged that on 24.11.2020 at about 5:00 pm her daughter eloped without any Information. FIR is against unknown.

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case. The Victim girl and the petitioner surrendered before the Court below on 28.01.2021 and the statement of the victim girl was recorded under section 164 of Cr.P.C in which she has stated that she had gone with the petitioner on her own volition and sweet will. Petitioner has got no criminal antecedent and is in

Patna High Court CR. MISC. No.19610 of 2022(2) dt.12-07-2022 2/2 custody since 29.01.2021.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with S.T. No. 35 of 2022 arising out of Sanokar P.S. Case No. 154 of 2020, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
