JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,447,323,324,325,307,354,504,506 and 379 of the Indian Penal Code.

It is alleged that the FIR named accused persons including the petitioner came to the house of the informant variously armed and started abusing the informant side. On protest being made, co accused Md. Naushad put country made pistol on the chest of the informant and threatened, in the meantime, on the order of co accused Md. Rabbis, the accused persons abused and assaulted the informant with fists and slaps and iron rod. On alarm being raised the son and relatives of the informant came to rescue

Patna High Court Cr.Misc. No.32229 of 2015 (2) dt.07-08-2015 2/2 then Md. Sahab, Wahab, Md. Aftab and Md. Sakir caught them and petitioner assaulted with iron rod to Md. Sakir. The accused persons assaulted the female of the house.

It is submitted by the learned counsel for the petitioner that the injury of Md. Sakir has been found to be superficial simple in nature. There is counter version of the occurrence. It is further submitted that for the occurrence of 2.9.2014 at 7 A.M. the FIR has been registered on 3.9.2014 at 8.30 A.M. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Saharsa in connection with Saur Bazar (Patarghat OP) P.S. Case No.416 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
