17-11-2017 Heard Sri Amrendra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 22-01-2017 in Khaira P.S. Case No. 14 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner was simply a driver of pick-up van and the owner of the vehicle, immediately after noticing the police, fled away, however; petitioner was apprehended and from the said vehicle, about 40 liter of Indian make foreign liquor was shown to be recovered. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to

Patna High Court Cr.Misc. No.55464 of 2017(2) dt.17-11-2017 2/2 show that petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Shahid Ali @ Ajay be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Khaira P.S. Case No. 14 of 2017.
