====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Mansi P. S. Case No. 142 of 2025 registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per F.I.R., on 14.06.2025, all the accused persons including petitioner surrounded informant and his family members and thereafter, co-accused Surendra Yadav and Sumit Yadav fired upon father of informant, as a result of which, he died on spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific accusation of firing is against co-accused Surendra Yadav and
Patna High Court CR. MISC. No.19749 of 2026(2) dt.01-05-2026 2/2 Sumit Yadav. So far as this petitioner is concerned, no specific role has been attributed against him. Petitioner claims clean antecedent and is in custody since 09.10.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Mansi P.
