The petitioner seeks bail in a case registered for offences punishable under Sections 461, 381 and 414 of the I.P.C. and Sections 37 (b) and 37(c) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, petitioner is the staff of informant, who runs a plywood shop and he always used to steal plywood from his shop and sell to Kamlesh Sharma. The petitioner in the last night sold ply worth Rs.50,000/-. The informant went to the shop of Kamlesh shamra and most of the ply was of his shop and Kamlesh Sharma, who was found in drunken stage, accepted that he used the purchase the ply from the petitioner. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Pupaspur P.S. Case No. 348 of 2017.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
