JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and the informant claims that the deceased was working with the petitioner in his clinic and, furthermore, the informant claims that the petitioner had taken Rs. 1,00,000/- (one lac) from the deceased on the pretext of getting her provide a job. The informant further claims that when the deceased mounted pressure upon the petitioner to return the aforesaid money, the petitioner committed murder of the deceased.

The first information report goes to show that the deceased left her home in the morning of 08-05-2015 but she did

Patna High Court Cr.Misc. No.25965 of 2016 (4) dt.05-10-2016 2/2 not return till night, upon which, her husband made inquiry and gave information to the informant about missing of the deceased. Furthermore, the first information report goes to show that on 1305-2015, a dead body was found on railway track and then, the informant verified and identified the dead body on the basis of clothes of the dead body. However, the present case was lodged on 07-01-2016 and in course of investigation, the son and the daughter of the deceased stated that the deceased had left her home disclosing that she was going to meet the petitioner and after that, the deceased was found missing. The investigation against the petitioner has already been completed.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rafiganj P.S. Case No. 03 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad. (Hemant Kumar Srivastava, J) A.K.V./- U T
