The petitioner is in custody in connection with Pipra Kothi P.S.Case No.18 of 2017 registered for an offence under Section 379 of the IPC.
It has been submitted that the petitioner is neither named in the FIR nor any incriminating material has been recovered from the possession of the petitioner. The case was registered against unknown. In course of investigation one co-accused Golu Alam was apprehended and he disclosed the name of this petitioner and except the disclosure of the name of this petitioner, there is nothing against him. The petitioner is in custody since 29.04.2017, having clean antecedent except Motihari Town P.S.Case No.175 of 2017 registered for the offence under Section 401 of the IPC. In
Patna High Court Cr.Misc. No.62904 of 2017 (2) dt.10-01-2018 2/2 that case, the petitioner is on bail.
The learned APP opposed the submissions.
In the facts and circumstances of the case, the prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Motihari, East Champaran in connection with Pipra Kothi P.S.Case No.18 of 2017 (GR No.471 of 2017).
