01-12-2021 Heard learned counsel for the parties.
The petitioner seeks bail in Bairiya P.S. Case No. 318 of 2019, registered for the offence under Sections 25(1-B)a, 26, 35 of the Arms Act.
On a secret information that some miscreants have assembled near Khiriya Ghat, a raid was conducted and two miscreants were apprehended, from whose possession one country-made pistol and live cartridges were recovered, and the apprehended co-accused persons disclosed the name of petitioner and others, who fled away from the place of occurrence.
It is submitted on behalf of petitioner that no arms or ammunition has been recovered from the possession of the petitioner and petitioner is in custody since 23.09.2020.
Patna High Court CR. MISC. No.29181 of 2021(3) dt.01-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the period of custody and the fact that no arms or ammunition has been recovered from the possession of petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, West Champaran at Bettiah in connection with Bairiya P.S. Case No. 318 of 2019.
