JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Upahara P.S. Case No. 26 of 2017 for the offence registered under Sections 147, 148, 149, 302, 341, 323, 324, 326, 307, 506 of the Indian Penal Code besides Section 27 Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Except that petitioner was member of the mob and armed with pistol, there is no overt act against this petitioner. There are many persons granted bail by co-ordinate bench of this Court including the persons against whom some of overt act was alleged.

Considering the aforesaid, let the petitioner, named above is directed to be released on bail on furnishing bail bond of Rs.10000/- (Rupees ten thousand) with two sureties of the

Patna High Court Cr.Misc. No.54190 of 2018(2) dt.20-09-2018 2/2 like amount each to the satisfaction of learned C.J.M. Aurangabad in connection with Upahara P.S. Case no. 26 of 2017.
