The petitioner apprehends his arrest in Kaler P.S. Case No. 17 of 2012 registered for the offences punishable under Sections 467, 468, 471 and 409 of the Indian Penal Code. The informant alleged that during course of audit Rs. 2,63,000/- was not found in the Nazarath and the petitioner being Nazir did not meet the objection of the audit. Learned counsel for the petitioner submits that the petitioner had advanced money to the Block Education Officer and to the Block Development Officer and other officers of the block. It is further submitted that Block Development Officer, Kaler has got account no. SB 19643 in which the BDO, BEO and other officers, who had taken advance from Nazarath already

Patna High Court Cr.Misc. No.25958 of 2016 (4) dt.05-09-2016 2/2 deposited the entire amount in Bank of India, Arwal Branch. Considering the facts aforesaid and the fact that the entire money has already been deposited by the persons who had taken advance, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Kaler P.S. Case No. 17 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
