JUSTICE SUDHIR SINGH ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149 and 302 of the Indian Penal Code. Allegation against the petitioner is that he along with other F.I.R. named accused persons had brutally beaten cousin brother of the informant to death.

It has been submitted on behalf of the petitioner that he is in custody since 28.5.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. The main assailants are Mritunjay Sharma and Sanjay Sharma. Petitioner is said to be the member of the unlawful assembly. No specific injury has been attributed against the petitioner. Co-accused, namely, Purushottam Sharma has been granted bail vide Cr. Misc. no. 16891 of 2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.26909 of 2016 (3) dt.29-08-2016 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Khudwan P.S. Case no. 4 of 2016.
