The petitioner seeks bail in Islampur P.S. Case No.08 of 2020, registered under Sections 341, 323, 504, 148, 149, 307, 447 and 342 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant disclosed in her fardbeyan that the petitioner had concealed several cartons of Indian made foreign liquor under a bridge and when Anil Garai, the husband of the informant protested, Sujit Kumar, Ajit Kumar, Rahul Kumar and Manoranjan Prasad, the petitioner and others having armed with different weapons came and threatened the informant and her husband to kill. They abused the informant and her husband and went away after firing.

Learned counsel for the petitioner submits that neither

Patna High Court CR. MISC. No.16359 of 2020(2) dt.03-06-2020 2/2 the informant nor her husband got any injury. The petitioner is in jail since 05.01.2020. The petitioner of course has got criminal antecedents and there are some cases registered under the Excise Act but the present case is a simple case of verbal altercation and hurling abuses.

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the petitioner is in jail since 05.01.2020, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, District Nalanda in connection with Islampur P.S.
