Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-341, 323, 379, 353, 504, 506 of the Indian Penal Code. Petitioner is named in the first information report with allegation that he snatched the motorcycle and cash from the informant.
Submission on behalf of the petitioner is that the informant had himself come to assault the petitioner and in the meantime, police came there but in collusion of the informant, police got instituted this false case. It is further submitted that so
Patna High Court Cr.Misc. No.26159 of 2016 (2) dt.05-07-2016 2/2 far as criminal antecedent of the petitioner is concerned; earlier several cases had been lodged against the petitioner but in almost all the cases, barring a few, he has already been acquitted after full-fledged trial.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bajpatti P.S. Case No. 45 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi.
