JUSTICE MUNGESHWAR SAHOO ORAL ORDER 27-03-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners, (1) Gopi Singh and (2) Gopal Singh apprehends their arrest in Teghra P.S.Case No.230 of 2013 under Sections 302, 201, 34 of the I.P.C.

According to the prosecution case, the father of the deceased lodged FIR alleging that his daughter was being brutally assaulted by son-in-law regularly. Subsequently, he learnt that his daughter was assaulted and she died and thereafter, the dead body was cremated. The informant learnt that the son-in-law, Mannu Singh and cousin brother, Gopi Singh and Gopal Singh assaulted and thereafter cremated the dead body.

Patna High Court Cr.Misc. No.38955 of 2014 (2) dt.27-03-2015 2 / 2 The learned counsel for the petitioner submitted that the assault is against the son-in-law, Mannu Singh. So far the petitioners are concerned, only allegation is that they participated in the cremation of the dead body.

Perused the FIR. It appears that in the FIR itself, the informant has stated she his grand daughter Rakhi Kumar told him that her mother was assaulted by her father.

In view of the nature of allegation against the petitioners that they only participated in the cremation of the dead body and the allegation in the FIR is that the informant had only learnt about the assault made by the petitioners, I direct both the above named petitioners to surrender before the Court below within one month from today and on their so surrendering, both shall be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No.230 of 2013.
