Mr. Smt. Sucheta Yadav ======================================= CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-09-2018 The petitioner seeks bail in connection with Maheshkhunt P.S. Case No. 167 of 2017 dated 21.11.2017 instituted for the offence under Sections 30(a), 41(i) of the Bihar Prohibition & Excise Act, 2016. 302 litres of country made liquor is said to have been recovered from a pick-up van of which the petitioner is owner.

The learned counsel for the petitioner has submitted that the vehicle was given to the driver and

Patna High Court Cr.Misc. No.54606 of 2018(2) dt.04-09-2018 2/2 without the knowledge of the petitioner, the aforesaid excisable items were kept in the pick-up van. The driver of the pick-up van has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 40975 of 2018.

The petitioner is in custody since 12.06.2018 and does not have any criminal antecedent.

For the aforestated facts, the petitioner, above named is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-I-cum-Special Judge, Excise, Khagaria in connection with Maheshkhunt P.S. Case No. 167 of 2017.
