Petitioner seeks bail in Saraiya P.S. Case No.55 of 2019 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that from the seizure list it will appear that recovery has been made from behind the house of the petitioner. Seizure list is part of the First Information Report, which does not bear signature either of the petitioner or his family members.

Petitioner is in custody since 15.02.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court CR. MISC. No.20532 of 2019(2) dt.03-04-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Saraiya P.S. Case No.55 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
