2. The petitioner is apprehending his arrest in connection with Barsoi P.S. Case No. 265 of 2025 for the offence under sections 126(2), 115(2), 118(1), 117(2), 352, 351(2) and 3(5) of the BNS lodged on 29.10.2025 by the informant, Sanahullah.

3. As per the prosecution story, the informant alleged that due to the land dispute, the accused persons armed variously assaulted both his sons who were shifted to SubDivisional Hospital, Barsoi and then to Sadar Hospital Katihar. This led to the FIR.

4. Learned counsel for the petitioner submits that there is a case and counter case, both sides have suffered injuries and those assaulted the petitioner's side have been

5. Learned APP opposes the prayer submitting that the injuries inflicted on the informant's son have been found to be grievous in nature.

6. Taking into account the submissions of the parties as also the nature of injury coupled with the fact that the petitioner has criminal antecedents, no relief can be extended.

7. In that background, the anticipatory bail application stands rejected.
