JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2019 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 19.09.2018 in a case registered for the offence punishable under Section 394 of the IPC.

The prosecution case, as per the written report of Mangal Mukesh Prabhakar, dated 24.07.2018 submitted to the Station House Officer, Jamalpur Rail Police Station, is to the effect that the informant was travelling by train from Jamalpur to Patna, on the way, a boy took the bag of the informant and threw it from the running train. Subsequently, the boy was caught by the informant when the informant took him near the bush where three accused persons were present, who assaulted the informant and robbed his mobile phone, gold ring, cash amount of Rs.

Patna High Court CR. MISC. No.18688 of 2019(2) dt.29-03-2019 2/2 1400/- and educational certificate of the informant, leading to registration of the FIR against unknown persons. Subsequently, during investigation, name of the petitioner sprang up and robbed mobile of the informant was also recovered from him. It is submitted by learned counsel for the petitioner that the chargesheet has been submitted against the petitioner without putting him on T.I. Parade. A statement has been made in paragraph no.3 of the petition that apart from present case, the petitioner also accused in other case, in which he is on bail. Learned APP that robbed mobile of the petitioner has been recovered from the petitioner.

Considering the fact that final report has been submitting without putting the petitioner on T.I. Parade and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Kiul (Lakhisarai) in connection with Jamalpur Rail P.S. Case No. 65 of 2018.
