2. The petitioner seeks regular bail in connection with S.Tr. No.1253 of 2022, arising out of Chhauradano P.S. Case No.127 of 2023 lodged under Sections 341, 323, 324, 307, 380, 447, 506, 504, 354B and 34 of the IPC and subsequently section 302 of the IPC has been added.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 31.01.2024 passed in Cr. Misc. No.2677 of 2024 with liberty that he may renew his prayer for bail nine months after framing of charge.
4. Learned counsel for the petitioner further submits that the petitioner's antecedent is clean and he is in custody since 03.08.2023. He further submits that charge has already been framed on 14.05.2024, but even after lapse of more than
Patna High Court CR. MISC. No.20531 of 2025(3) dt.25-07-2025 2/2 one year, trial has not been concluded. He further submits that it has been observed in the rejection order that petitioner is not criminal rather at the spur of moment, dispute has occurred from both sides.
5. Learned counsel for the State opposes the prayer for bail.
6. Counsel for the Informant vehemently opposes the prayer for bail and submits that only doctor and I.O. has to be examined and rest all witnesses have already been examined.

In the present facts and circumstances of this case and the submissions made above and from the record, it transpires that for the same date and place of occurrence, there is case and counter case from both the sides. As such, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Addl. District Judge-21st, Motihari in connection with S.Tr. No.1253 of 2022, arising out of Chhauradano P.S. Case No.127 of 2023, subject to the following conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Dr. Anshuman, J.) Prakashmani/- U T
