JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406/34 of the Indian Penal Code.
It is alleged that the petitioner being employee of the licenced wine shop of the complainant was handed over a challan of one lac rupees to be deposited in the Sasaram branch of State Bank of India but the petitioner did not deposit the said challan. It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the challan was
Patna High Court Cr.Misc. No.34509 of 2015 (2) dt.25-08-2015 2/2 entrusted to the petitioner and for the entrustment made on 27.10.2014 the complaint was filed on 24.11.2014 by the complainant in order to save his own skin for being prosecuted at the hands of the government. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the delayed nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Complaint Case No. 1303 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
