JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 This application, for grant of anticipatory bail, arises out of Rajepur P.S. Case No. 19 of 2018, disclosing offences under Sections 366(A). 379, 376, 302, 201, 120(B) of Indian Penal Code.

Allegation against the petitioners and others is that they kidnapped the minor daughter of the informant and confined her for several days and committed rape on her and, thereafter, she was killed by setting her on fire. Submission of learned counsel for the petitioner is that entire allegation is false and concocted and in fact the deceased was in love affair with petitioner no. 1 and they have also performed marriage and was living together but on

Patna High Court CR. MISC. No.21633 of 2019(4) dt.15-07-2019 2/2 31.05.2017, the deceased while preparing food caught fire and sustained burn injuries and, thereafter, succumbed to her injuries.

Learned counsel for the State opposed the prayer for bail.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioners.
