JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 307, 324 and 34 of the Indian Penal Code and 27 of the Arms Act.
Prosecution case, in brief, is that one person, namely. Ajay Kumar received fire shot at his jaw by the accused persons and his bag was also missing.
It has been submitted on behalf of the petitioner that he is in custody since 17.3.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. Subsequently, after four days the written statement is said to have been filed where the informant has claimed to have identified the petitioner as a member of the unlawful assembly. The alleged occurrence is said to have taken place at 9:30 in the night. No source of identification has been disclosed by the prosecution.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur Town P.S. Case no. 62 of 2016.
