The petitioner seeks bail in a case instituted under Sections 304(B)/34 of the Indian Penal Code.
The allegation against the petitioner is that he along his family members committed murder of the daughter of the informant by sprinkling kerosene oil upon her body due to nonfulfillment of the demand of dowry. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.12.2015. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely
Patna High Court Cr.Misc. No.32562 of 2016 (4) dt.20-09-2016 2/2 been implicated in the present case. The alleged date of occurrence was 12.02.2015 and the fardbeyan was recorded on 26.02.2015. The case has been instituted on 09.03.2015. The delay has not been explained by the prosecution. Para-60 of the case diary states that the petitioner and the deceased both had sustained burn injury, for which, petitioner and deceased were being treated by medical doctor. Later on, the deceased succumbed to the injury.
On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Saran at Chapra, in connection with S.Tr. No. 224 of 2016 (183/16), arising out of Garkha P.S. Case No. 58 of 2015. (Sudhir Singh, J.) Amit/- U T
