The petitioner seeks bail in a case registered for offences under Sections 272, 273, 290 and 294 of the Indian Penal Code and Sections 30 (A) and 37(C) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 64.80 litres of Nepali Soufi Wine was recovered from the joint possession of ten co-accused persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 20.05.2017.

No.53780 of 2017(2) dt.09-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Sitamarhi in connection with Bairgania P.S. Case No. 123 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
