====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Khaira P.S. Case No. 353 of 2018, instituted for the offence under Section(s) 121, 120(B)/34 of the Indian Penal Code, Sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act.

Counsel for the petitioner submits that there is no recovery of any incriminating article from possession of the petitioner. Petitioner has been arrested merely on suspicion. It is alleged in the written report that on suspicion, the Police arrested this petitioner who tried to run away from Motorcycle. On search, nothing has been recovered from possession of the petitioner except one Mobile Phone and some Naxali Parcha.

Petitioner is in custody since 10.09.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No. 353 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
