BAJANTHRI ORAL ORDER 18-05-2023 In the instant petition, petitioner has prayed for the following relief(s):- "1. That this application is being filed to quash and set aside the order contained in memo no. 227 dated 31/03/2020 passed by Sub-Divisional Officer Kishanganj suspending the PDS license of the petitioner and order dated 16/04/2022 passed in Suppy Appeal case no. 59/2021 by the District Magistrate Kishanganj affirming the aforesaid order of suspension."

2. The petitioner's PDS license is stated to have been suspended on 31.03.2020. Officials of the respondent are awaiting for outcome of the criminal proceedings. Criminal proceedings would take its own time. Therefore, the petitioner shall not be penalized merely suspending the license for an indefinite period.

3. Therefore, the concerned authority is hereby directed to revoke the suspension of license subject to outcome of the criminal proceedings.
