JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Triveniganj P.S. Case No.28 of 2014 registered for the offence punishable under section 135 of Electricity Act, 2003. According to the prosecution case, the petitioner was dishonestly consuming electricity and operating a 7.05 H.P. electric motor for the purpose of running flour-mill. The electrical energy was being abstracted from the main three phase L.T. line through illegally connected cable.

Regard being had to the gravity of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,

Patna High Court Cr.Misc. No.35857 of 2014 (2) dt.01-04-2015 2/2 the prayer for bail is rejected.

The petitioner may surrender and seek bail which shall be considered on its own merit without being prejudiced in any manner by this order.
