JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Murliganj P.S. Case No. 39 of 2015, registered under Sections 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code and Section 27 Arms Act.

The accusation is that seven persons named in the F.I.R., including the petitioner reached near the informant and at the order of Md. Jakir, Md. Salam shot fire at the informant, who fell down, at that time Md. Atabul snatched golden chain from his neck and this petitioner took cash of Rs. 5000/- from the pocket of the informant.

Learned counsel for the petitioner submits that although petitioner is named in the F.I.R., but there is specific

There is only allegation against the petitioner is that he took Rs. 5000/- from the pocket of the informant is superaddition only to make the case non-bailable against the petitioner. The petitioner having no criminal antecedent is in custody since 17.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S.
