2. In this case, the petitioner is seeking regular bail in connection with Begusarai Town P.S. Case no 607 of 2024 N.D.P.S. Case no 62 of 2024 registered for the offences under sections 08, 20 (B), (ii) (a) & 22 (a) of the N.D.P.S. Act

3. According to prosecution case, co-accused Nitish Kumar was arrested with 12 gms of smack. He disclosed the name of this petitioner and another co-accused, who were said to have fled away from the place of occurrence.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He has further submitted that co-accused Nitish

Patna High Court CR. MISC. No.23459 of 2025(3) dt.06-08-2025 2/2 Kumar has been granted bail by a coordinate Bench of this Court vide order dated 11.04.2025 in Cr. Misc. No. 16172 of 2025 and the case of the petitioner is on better footing to that of co-accused Nitish Kumar.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st cum Special Judge NDPS Begusarai in connection with Begusarai Town P.S. Case no 607 of 2024 N.D.P.S. Case no 62 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
