JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody since 25.04.2016 in a case registered for the offences punishable under Sections 25(1B) (1-A)/26 of the Arms Act. One firearm and 10 live cartridges are said to have been recovered from the roof of the house of the petitioner. Submission on behalf of the petitioner is that petitioner has been implicated in this case at the behest of one Pintu Paswan who has political rivalry with the petitioner and moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody from 25.04.2016.

Considering the aforesaid facts and circumstances as well as

Patna High Court Cr.Misc. No.27221 of 2016 (3) dt.05-09-2016 submissions of the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 131 of 2016.
