JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2016 Petitioner being father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B/34, 120B of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after about six years of marriage for non-fulfilment of dowry demand.

It is submitted by learned counsel for the petitioner that in fact the marriage was performed on 24.04.2008 but deliberately the wrong date of marriage has been mentioned in the F.I.R to bring the case under the purview of Section 304B I.P.C. It is further submitted that petitioner is old person and the specific accusation of demand of dowry is against the husband of the victim. Moreover for the occurrence of 23.03.2016 the F.I.R was registered on

Patna High Court Cr.Misc. No.28232 of 2016 (2) dt.14-07-2016 2/2 01.04.2016.

Considering the delayed lodging of the F.I.R, the advanced age of the petitioner and the thrust of accusation against the husband of the victim, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 113 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
