Petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 427/34 of Indian Penal Code and Section 27 of Arms Act.

Petitioner claims parity with other accused persons Lakshman Ram, Naresh Ram and Ramchandra Ram @ Ramchandra Paswan, who have been allowed anticipatory bail by this Court in Cr Misc No 61906 of 2017. It is submitted that, being a Government Teacher, petitioner has been falsely implicated in this case. It is further submitted that from the allegations made in the first information report, it is apparent that specific and direct allegation, if any, was against co-accused

Patna High Court Cr.Misc. No.63279 of 2017 (3) dt.17-02-2018 2/2 Akhilesh Ram and Lakshman Ram. Prior to the instant case, petitioner has one antecedent which was also at the instance of the same persons and in that case, he is on bail. In the instant case, he is in custody since 15.10.2017.

Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Narkatiaganj, District - West Champaran in Inarwa Police Station Case No 69 of 2017 dated 18.07.2017 corresponding to GR No 3138 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails do so on two consecutive dates, his bail will be liable to be cancelled.
