JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,307,379,337,341,323,324 and 504 of the Indian Penal Code.
The prosecution case is that on 15.12.2014 at 7 A.M. the informant' father and three uncles were preparing bundles of paddy when accused persons came with spade and stick and began to fill up road by cutting soil from the land of the informant. On protest being made, the informant side was abused and the accused persons made assault to the father and uncle of the
Patna High Court Cr.Misc. No.30710 of 2015 (2) dt.30-07-2015 2/2 informant. It is further alleged that the accused persons have constructed road on the raiyati land snatched gold chain and cash from the informant's brother.
It is submitted by the learned counsel for the petitioners that in the background of bonafide land dispute the accusation has been levelled. There is counter version of the occurrence and the accusation of assault is omnibus and general. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Hulasganj P.S. Case No. 101 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
