JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Pakridayal P.S. Case No. 193 of 2014 for the offence under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

Heard learned counsel for the petitioners and the State.

The prosecution story, in brief, is that the Branch Manager, Uttar Bihar Gramin Bank, Pakridayal has sent L.P.C. and rent receipt for verification of 30 persons which was enquired and found that all the L.P.C. and rent receipt have not been issued by the Circle Officer or by any of the Circle Officer and in fact the signature on the L.P.C. and rent receipt is fake. It is submitted on behalf of the petitioner that the petitioners have got no criminal antecedents. The petitioners

Patna High Court Cr.Misc. No.30636 of 2015 (2) dt.30-07-2015 have been implicated in the present case due to mistake of fact. It is submitted that no loan amount has been disbursed in favour of the petitioners. Others co-accused have been granted anticipatory bail vide Cr. Misc. No. 21013 of 2015. On behalf of the State, it has been submitted that the petitioners have been named in the First Information Report.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Champaran, Motihari in connection with Pakridayal P.S. Case No. 193 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
