JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 8(c), 21(b), 22(b) of the N.D.P.S. Act. There is recovery of 7.28 grams of brown sugar/smack from the possession of one Gulzari Prasad Sinha. The apprehended accused disclosed that he purchased the brown sugar/smack from the petitioner for selling it in the locality.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not
Patna High Court CR. MISC. No.18892 of 2023(2) dt.17-05-2023 2/2 apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the apprehended accused or the seized contraband. Moreover, the seized brown sugar/smack is much less than the commercial quantity of 250 grams. The petitioner is languishing in custody since 13.11.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge(NDPS Act), Purnea in connection with Sarsi P.S. Case No. 61 of 2021, Special (NDPS Act) Case No. 38 of 2021(Supplementary)/CIS No. 08 of 2023.
