The petitioner apprehends his arrest in Complaint Case No. 589(C) of 2012, corresponding to T.R. No. 1523 of 2013, registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. The petitioner is the husband. The wife has made allegation that she was married to the petitioner on 07.05.2007, but her husband demanded different articles. She also alleged that while she was pregnant, her husband assaulted her causing her abortion.
Patna High Court Cr.Misc. No.34214 of 2014 (2) dt.12-02-2015 2/2 Learned counsel for the petitioner submits that the petitioner gives undertaking and he is ready to pay a sum of Rs. 1000/- per month for her maintenance.
Considering the facts aforesaid and the fact that the petitioner is ready to pay maintenance of Rs. 1000/- per month to his wife, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Buxar in connection with Complaint Case No. 589(C) of 2012, corresponding to T.R. No. 1523 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioner shall pay the amount of maintenance each month by the 10th of every month.
