Petitioners no. 1 and 2 being father and brother of the husband of the victim and petitioner no. 3 being husband are apprehending their arrest in a case registered for the offences punishable under Sections 306/34 of the Indian Penal Code. The prosecution case is that the daughter of the informant committed suicide due to torture inflicted by the husband and inlaws. It is submitted by the learned counsel for the petitioners that only on suspicion, accusation has been levelled and the victim died after eight years of the marriage.
Patna High Court Cr.Misc. No.31073 of 2015 (2) dt.04-08-2015 2/2 Considering the nature of accusation levelled against the petitioners no. 1 and 2, let them in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Konch P.S. Case No. 165 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
So far as the Petitioner no. 3 being the husband of the deceased, let learned court below consider the prayer for regular bail if he surrenders within a period of six weeks in connection with Konch P.S. case No. 165 of 2014.
With the observations above, the application of petitioner no. 3 stand disposed off.
