The petitioner seeks bail in a case registered for offences under Section 47A of the Excise Act. It is contended that, as per allegation, 50 litres of country-made liquor was recovered from the house of the petitioner kept in a jerkin and tube. It is contended that the petitioner has no criminal antecedent. It is urged that the petitioner is in custody since 06.08.2018.
Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on
Patna High Court Cr.Misc. No.59817 of 2018(2) dt.06-10-2018 2/2 bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, West Champaran at Bettiah in connection with Excise Case No. 12 of 2007 (Tr. No. 2295 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
