JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned APP.
Two minor girls namely, Sima Kumari as well as Anjali Kumari were enticed away by the petitioner along with Sujit Kumar, Dharmendra Kumar and Dipak Kumar and for that, a written report was filed by Vijay Kumar Sah, father of Sima Kumari.
Both the victims have been recovered and they, in their statements under Section 164 Cr.P.C., pin pointed the petitioner along with Sujit Kumar to be the culprits who forcibly took them away. It is evident from their statements that petitioner after staying for some time at Bharmaddi School escaped after seeing the public, while Sujit took away both the girls and during course thereof, as has been disclosed by Anjali, she was physically harassed.
Patna High Court Cr.Misc. No.25402 of 2016 (3) dt.14-07-2016 Considering the allegation, for the present, I do not see it a fit case for grant of bail. Accordingly, prayer for bail is rejected.
However, if so advised, petitioner may renew his prayer for bail after framing of charge.
