JUSTICE RAVI RANJAN ORAL ORDER 20-03-2015 I have heard learned counsel for the petitioner. No one appears for the State.
The petitioners apprehend their arrest in connection with a case registered for offences punishable under Sections 341, 323, 324, 307, 337, 379 and 504/34 of the Indian Penal Code. It is submitted that occurrence took place due to the land dispute between the family members of the petitioners and the informant as they are having adjoining agricultural lands. It is further submitted that this case has been filed as the counter case to the first information report lodged by the petitioner no.1 being Banka P.S. Case No.442/20, thereafter, the present case as Banka
Patna High Court Cr.Misc. No.39577 of 2014 (2) dt.20-03-2015 2 / 2 P.S. Case No.443/2013 has been filed by the informant of this case. It is urged that all the injuries are simple except one upon Harish Kumar Madhukar and that is not on the vital part rather the same is on the arms. It is also contended that petitioners do not have any criminal antecedent.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Manku Pandit @ Malku Pandit, Ranjit Pandit and Panchanand Kumar Pandit @ Panchanand Kumar @ Panchu Pandit be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Banka P.S. Case No.443/13, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the C.J.M.
