JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Petitioner no.1 is the mother-in-law of the deceased, petitioner No.2 is the brother of the husband of the deceased and petitioner no.3 is wife of petitioner no.2.

Learned counsel appearing on behalf of the petitioners has submitted that the allegation of demand of dowry and torture, therefor, is vague and omnibus and there is no specific allegation against these petitioners.

Patna High Court Cr.Misc. No.6722 of 2015 (4) dt.09-07-2015 Considering the facts and circumstances and the fact that the petitioners are near relatives of the husband and considering the submission that there is no chance of the petitioners fleeing away from the course of investigation on trial, let the above named petitioners in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Garkha P.S. Case No. 104 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is made clear that the above named petitioners shall cooperate with the police in course of investigation and shall present themselves before the Court as and when required in connection with the said Garkha P.S. Case No. 104 of 2014, failing which the prosecution shall be at liberty to approach this Court for cancellation of bail.
