JUSTICE SUDHIR SINGH ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 307, 120B and 353 of the Indian Penal Code, Sections 3 and 4 of the Explosive Substances Act and Section 17 of the C. L.A. Act.
Allegation against the petitioner is that he along with other accused persons kept bombs wrapped in red cloth at booth nos. 227, 228 and 232 in order to create disturbance in the Lok Sabha Election.
It has been submitted on behalf of the petitioner that he is in custody since 12.10.2015. Chargesheet has been submitted against the petitioner. There is no allegation of tampering of evidence against the petitioner. Petitioner has been named in the F.I. R. merely on the basis of suspicion. There is no substantive evidence to suggest his implication in the present case. There is no recovery of any incriminating article from the possession of the petitioner.
On behalf of the State, it is submitted that petitioner is
Patna High Court Cr.Misc. No.25430 of 2016 (4) dt.10-08-2016 2/2 named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Dhibra P.S. Case no. 11 of 2014, (Sudhir Singh, J) sudip/- U T
