JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was twice rejected by this Court but while rejecting the prayer for bail of the petitioner vide order dated 17.05.2017 passed in Cr. Misc. No. 3417, this Court directed the trial court to conclude the trial of the petitioner within four months from the date of receipt/ production of a copy of aforesaid order and liberty was granted to the petitioner to renew his prayer for bail, if his trial is not concluded within the above stated period.
The trial court has reported that up till now out of ten proposed prosecution witnesses only three prosecution witnesses could be examined. The aforesaid report of the trial court goes to
Patna High Court Cr.Misc. No.63633 of 2017 (3) dt.31-01-2018 2/2 show that there is no progress in the trial of the petitioner even after direction issued by this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Session Judge-IVth Rohtas at Sasaram in connection with Kochas P.S. Case No. 100 of 2014, Session trial no. 179 of 2015. (Hemant Kumar Srivastava, J) N.K/- U
